2. Validity of the privacy statement

This privacy statement applies to the FidesSecur Versicherungs- und Wirtschaftsdienst Versicherungsmakler GmbH (FidesSecur). Our website can contain links to third-party companies. Our privacy statement does not relate to these third-party companies.

3. FidesSecur guarantees that it treats your personal data in confidence in that

we subject our employees to confidentiality obligations,
our security precautions are state-of-the-art and
the company data protection officer observes compliance with the “privacy statement”.

4. Use of your personal data when visiting our website

When you access our website www.fidessecur.de, the browser that is used on your end device automatically sends information to our website server. This information is temporarily saved in a so-called log file. In the course of this procedure, the following data is collected and stored, without any action on your part:

IP address of the querying computer,
Date and time of the access,
Name and URL of the accessed file,
The website from which the access has taken place (referrer URL),
The browser used and, if necessary, the operating system of your computer as well as the name of your access provider.

The data in question are then processed by us for the following purposes:

Guaranteeing a smooth connection to the website,
Guaranteeing the comfortable use of our website,
Evaluating the system security and stability as well as
For further administrative purposes.

The legal principle for the data processing is art. 6 par. 1 S. 1 lit. f DSGVO. Our legitimate interest follows the above-listed purposes for data collection. Under no circumstances do we use the data acquired for the purpose of drawing conclusions about you as an individual.

Recipient

The recipients of the data in this regard are solely technical service providers who act as processors involved in the operation and maintenance of our website.

Storage period

Your data will be erased as soon as it is no longer required for the purpose for which it was originally collected. In the case of data collected to ensure the proper functioning of the website, this typically happens at the end of a session.

Data requirement

While the provision of the aforementioned personal data is not a statutory or contractual requirement, without an IP address, we may not be able to ensure the proper functioning of our website, and some services or functions may not be available at all or only to a limited extent. For this reason, the right to object is excluded in this case.

5. Cookies

We use cookies on our website. These are small files that are automatically created by your browser and stored on your device (laptop, tablet, smartphone or similar) when you visit our site. Cookies do not cause any damage to your device and do not contain any viruses, trojans or other malware.

Information is stored in the cookie that is related to the specific device used. This does not mean, however, that we receive any direct knowledge of your identity.

The use of cookies serves on the one hand to facilitate your navigation and to ensure that our web pages are displayed correctly (= essential cookies). We use what are known as session cookies to recognise that you have already visited specific pages of our website. These are automatically deleted after leaving our site.

UserCentrics Consent Manager

Our website uses the Consent Manager from Usercentrics GmbH, Rosental 4, 80331 Munich, Germany, e-mail contact@usercentrics.com. The Consent Manager from Usercentrics is a solution that we use to obtain your consent for certain data processing activities that require your consent (e.g. tracking or similar). It informs you about the individual cookies and tools we use and allows you to choose which of them you allow or reject individually or by category. You will also be informed when you have allowed or rejected which cookies/tools. This enables you to make an informed decision about sharing your data and enables us to use cookies and tools in a transparent and documented manner that complies with data protection regulations.

The Consent Manager itself does not store any of your personal data. Only anonymised data is generated, which is stored in a cookie. This data is processed exclusively within the European Union. This data comprises the following information:

Information on the browser, e.g. browser type/version
Your anonymised IP address
Your consent or rejection of cookies

We do not use the information we collect through UserCentrics cookies to create user profiles or to evaluate your browsing behaviour. We process your personal data for the technical operation of our website on the basis of the following legal grounds:

for the fulfilment of a contract or for the implementation of pre-contractual measures pursuant to Art. 6 para. 1, point (b) of the GDPR, insofar as you visit our website in order to obtain information about our products and our events
for the fulfilment of a legal obligation to which we, as the responsible party, are subject pursuant to Art. 6, para. 1, point (c) of the GDPR. Our legal obligation is to obtain and document your consent to data processing.
for the protection of our legitimate interests pursuant to Art. 6, para. 1, point (f) of the GDPR. Our legitimate interests are to provide you with an appealing, technically functional and user-friendly website, to take measures to protect our website from cyber risks, and to prevent our website from posing cyber risks to third parties.

Google Tag Manager

On our website we use the Google Tag Manager. Google Tag Manager is a solution that allows marketers to manage website tags through a single interface. The Google Tag Manager service itself (which implements the tags) is a cookie-free domain and does not collect any personal data. The Google Tag Manager service triggers other tags, which in turn may collect data. Google Tag Manager does not access this data. If a deactivation has been made at the domain or cookie level, it will remain in place for all tracking tags implemented with Google Tag Manager.

You have the right to object to this processing. For this purpose, please send us your reasons relating to your particular situation, pursuant to Art. 21, para. 1, sentence 1 of the GDPR.

Google Analytics

For the purpose of statistical analysis of the use of our website, we use Google Analytics and with it cookies, which allow an analysis of your browsing behaviour. This allows us to improve the quality of our website and its content. We learn how the website is used and can therefore constantly optimise our offer.

The information obtained through the statistical analysis of our website will not be merged with your other data collected through the website.

Google Analytics is a web analytics service provided by Google Ireland Ltd. (Gordon House, Barrow Street, Dublin 4, Ireland; “Google”) and uses “cookies”, text files that are stored on your computer and allow analysis of how you use the website. The information generated by the cookie about your use of our website is typically transmitted to a Google server in the USA and stored there. On our website we use Google Analytics with the extension “_anonymizeIP()”. This means that your IP address will be truncated beforehand by Google within member states of the European Union or in other member states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and truncated there. The possibility of a direct reference to a person can therefore be excluded. Google will use this information on our behalf for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to the website operator. The IP address transmitted by your browser within the scope of Google Analytics will not be merged with other Google data.

With the help of this tracking tool, the behaviour of visitors to our website can be evaluated and their interests analysed. For this purpose, we create a user profile under a pseudonym.

Providing your personal data is voluntary and based solely on your consent. If you refuse to do so, you may not be able to use the full functionality of this website.

The data collected in Google Analytics is deleted 26 months after your last visit to the website.

Demographic characteristics in Google Analytics

This website uses the Google Analytics “demographic characteristics” function. This allows reports to be generated that include statements about the age, gender and interests of site visitors. This data comes from Google’s interest-based advertising and third-party visitor data. This data cannot be assigned to a specific person. You can deactivate this function at any time via the ad settings in your Google account or prohibit the collection of your data by clicking on the following link under the option “Google AdWords Remarketing”.

6. Integration of Google Maps

Google Maps, a service of Google, Inc., is integrated on our website for you.

To increase the protection of your data when visiting our website, Google Maps is limited and only integrated into the page using an HTML link. This ensures that no connection is established with Google’s servers when you visit our website and that your data is not transmitted to Google. Only when you activate the plugins, and thus give your consent for data transfer, will your browser establish a direct connection to Google’s servers so that you can plan your route to us. Functionally, the integration of Google Maps is therefore a hyperlink, so that neither we nor Google collect any data from you on our website.

Google also processes your personal data in the USA and uses standard contractual clauses of the EU Commission for security.

7. Contact form

Description

The data you enter will be stored to personalise the communication with you, e.g. as part of a request for advice. We require a valid email address and your name for this purpose. We use this data and time stamps to assign your query and to respond to it. The submission of additional data is optional. If you require advice, your data will be sent to the selected / responsible person. While you provide your personal data on a voluntary basis, please note that we need your name, your email address and the reason for the request to process your query.

Legal basis

The data entered in the contact form are processed based on a legitimate interest (Article 6 (1) (f) GDPR). The purpose of the contact form is to make it easy for you to contact us.

If you contact us to request a quotation, the data entered in the contact form will be processed to implement pre-contractual measures (Article 6 (1) (b) GDPR).

Storage period

Personal data related to a request for quotation will be erased no later than 6 months after the request has been processed or completed.

If this gives rise to a contractual relationship, we will be subject to the statutory retention periods under the German Commercial Code (HGB), meaning that we will only be able to erase your data at the end of the relevant retention period.

8. Mailgun

Mailgun is a service provided by Mailgun,Inc. (620 Folsom St, Ste 100, San Francisco, CA 94107, USA) for sending our emails. This service may also collect data about the date and time messages were read by the user, as well as when the user interacts with incoming messages (e.g., by clicking on links contained therein). The Company is party to the Safe Harbor Agreement with the EU and is therefore committed to upholding European data protection standards (https://www.mailgun.com/privacy).

obtain information about the data concerning you that we store and process (Article 15 GDPR),
rectification of incorrect personal data (Article 16 GDPR),
erasure of the data concerning you that we store (Article 17 GDPR),
restriction of processing where we are not yet permitted to erase your data for legal reasons or where a more detailed review must be carried out beforehand (Article 18 GDPR),
object to the processing of your data in accordance with Article 21 GDPR and the right to
data portability, if you have consented to data processing or have concluded a contract with us (Article 20 GDPR).

We do not use automated decision-making, including profiling within the meaning of Article 13 (2) (f) GDPR in conjunction with Article 22 GDPR.

Where you have given us your consent, you have the right to withdraw that consent at any time with effect for the future. To do this, an informal notice of withdrawal by email will suffice. The withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

In respect of infringement of GDPR, you have the right to lodge a complaint with a supervisory authority, in particular, in the member state of your habitual residence, your place of work or the place of the alleged infringement. You have the right to lodge a complaint without prejudice to any other administrative or judicial remedy.

10. Secure communication on the Internet

Generally speaking, the Internet is considered to be an unsafe medium. By contrast with, for example, the telephone line, a transfer of data on the Internet can easily be heard, recorded or even changed by unauthorized third parties. To guarantee the confidentiality of the communication with you, we use so-called SSL encryption (secure socket layer) that is based on state-of-the-art technology. According to the current standard of knowledge, the 256-bit encryption possible with this is considered secure. All of the latest browsers achieve this security level. If necessary, you should update the browser on your PC. Whether a single page of our website is transmitted in an encrypted format can be seen from the closed representation of the key or padlock icon in the bottom status bar of your browser.

We apply appropriate technical and organisational security measures in order to protect your personal data from intentional or unintentional manipulation, partial or complete loss, destruction or against unauthorised access by third parties. Our security measures are continuously improved in line with technological progress.
